A new Group has surfaced out there - this time originating in Canada on Facebook. By "like"ing this page you join a group of concerned people - Canadians especially though not limited to - who want prosperity in the world with a revived conservative moral and fiscal standard which includes but is not limited to the removal of Barack Hussein Obama from the office of President of the United States.

We were going to call this group Canadians United Against The Reelection of Barack Obama in 2012 but actually we are against his reelection in ANY year since if he fails this year he could conceivably run again to serve his second term at any time. In fact (here's a scary thought) Jimmy Carter could run again and serve another 4 years. We don't EVER want Obama reelected - not in 2012 - not ever. Canada needs its biggest trading and military partner healthy and prosperous. Barack Obama has shown a near eagerness to destroy that vision; seemingly on purpose.

SPECIATION: Darwin's Strawman and Evolution's most EPIC Fail

Mike Shoesmith here. In a recent debate between myself and four atheists evidence was given for microbe-to-man evolution that was typical, boring, and certainly nothing new. They trotted out the old tired hero - bacteria! They claimed that speciation has been "proven" - case closed. Here are my thoughts on the subject.

Very few people in the arena of philosophical ideas have never heard of Darwin's finches; birds with different size beaks which serve different purposes depending on various demands placed on them by their surrounding habitat. Ever since then these adaptive natural selection traits have been documented and even observed in cases where reproduction happens quickly.

One of these is the hero of modern atheistic evolution theory. Bacteria reproduce quickly and therefore can be observed over many generations. The process of speciation happens when traits develop in subsequent generations to allow a bacterium to perform tasks it could not previously accomplish. This may involve digesting a food source when introduced into a foreign environment. This is the case with nylon-eating bacteria. E-coli have recently been caught in the act of speciation and yeast bacteria have been a source of great adaptation ability. Yet none of this comes as any surprise to creationists. In fact we owe a great debt of gratitude to those folks out there who went to such great lengths to prove speciation since that is exactly what the Bible predicts and exactly what we would expect to happen following the flood!

Noah was not commanded to load up two of every "species" on the Ark. That would require a boat much larger than the one built. Knowing that speciation would occur Noah was commanded to load only two of every "kind". Two dogs for example, probably a wolf-like creature, have been speciating ever since. Likewise for all the rest of the land-dwelling creatures of the day. Even dinosaurs - though we're looking at smaller versions of those today.

So to all the evo-heads out there trying to prove microbe-to-man evolution by showing evidence for speciation - thanks for giving us even more assurance that the Bible is true and atheism is silly.

Finally here's something to ponder - if all the videos on youtube which strawman the argument by proving speciation and saying it proves Darwinian evolution were deleted from youtube's servers today - that would require the largest defrag in history. Hehehehe. Thanks for reading.

EPIC DEBATE - PPSIMMONS Takes on FOUR Atheists

Apart from a few minor flaws the only real mistake made by Mike Shoesmith in his recent debate was that he used too many big words for the panel of atheists to digest.

The video embedded at the bottom of this article is the two-hour long debate recorded by Mr. Shoesmith wherein he forced himself to endure the same old cliche'd one-liners offered by atheists ever since Darwin uttered them upon the death of his young daughter; the ultimate cause of his delusion finally taking hold. With familiar phrases like "look - a bacterium has speciated therefore evolution MUST be true!" Never mind the fact that speciation is predicted by the Bible. How else could a single pair of dogs (wolves probably) turn into the many breeds we see today? When Noah brought them onto the ark he was likely fully aware of the ability of animals to speciate. However the atheist fails to admit that the observations made confirm that speciation is confined to the "kind" or genus. And it was the "kind" that God created. It was the "kind" that was brought on board the ark. And it is these same "kinds" we see running, swimming, hopping, and whatever else they do on the earth to this very day. Bacteria remain bacteria and people remain people. That's real, observable science.

Another issue brought up by Mr. Shoesmith was that of Christianity being an "Existential Paradox". Without a doubt this concept completely confounded the out-of-their-league a-supernaturalists who had comfortably inserted "christians" into a nice tidy little definition. In fact Christianity can be just as much a religion as anything else be it golf or dentistry. So many people are easily talked out of their faith in college or university because it was, for them, nothing more than fire insurance - something their parents or pastor told them was true. When a more sophisticated, nuanced idea emerges from the lips of a professor who knows the multi-syllable words mom and dad could never wrap their feeble minds around, well, the sarcasm-laced religion of atheism takes root and they simply exchange one religion for another.

There are many who live their days in the closed-minded arena of atheistic belief yet never force it on anyone else. And then there are those who live their lives with a religious conviction to eradicate the belief in transcendental realities altogether. The group who took on Mr. Shoesmith were this type of atheist. They invited him to discuss cannibalism as a ruse to debate their religious tenets - cannibalism, naturalism, liberalism, etc. They, as many others, are no different than the Jehovah's Witness or Mormon who walk the streets knocking on doors trying to convince anyone who dares open their door enough for a foot to get in that their religion is the right one. Atheism is a closed-minded delusion excluding all other possibilities than the natural. You will hear, should you listen to the debate embedded at the end of this video, the atheists say several times that nothing exists outside of nature - a clear violation of the converse fallacy of accident. This is the same fallacious argument which would boldly declare that because one has never seen a black swan no black swans could ever possibly exist. This in spite of the mountains of anecdotal evidence which supports the existence of supernatural realities.

The debate quickly shifted to evolution. Mr Shoesmith was quick to point out that he is not a scientist yet the panel offered their typical and predictable evidences anyway. They are, as they always are, bacteria. Yes - the hero of modern evolution. Nylonse, E-coli, my oh my. The problem with this rather limited evidence is the fact that the Bible happily predicted the speciation we observe in biology. They offered another little piece of recent evidence and asked us to look into it while they ignored Mike's recent evidence in favor of Young Earth Creationism; a tactic of plugging one's ears and pretending they don't hear.

The evidence they proposed involves yeast. We found the research out of McGill University here. But we defer to the interpretation from our peers concerning the science of this discovery.

From Brian Morris M.S. of the Institute for Creation Research we see creation scientists way ahead of the pack on these issues - unafraid to look at all of the evidence with clear heads and open minds. Yet the atheists are comfortable ignoring the evidence which extensively refutes the evolution claims at every turn.

There are many scientific explanations for yeast cell replication which do not invoke deep-time mythology. See creation ministries international for a great deal of education on yeast right here. There is no need to credit the creation myth for modern atheism for speciation among bacteria. Once again another atheist hero goes down in flames. Logically speaking, and Mr. Shoesmith's favorite topic, atheism is indefensible based solely on logic itself. Modern naturalistic atheism is a logical wasteland. It is the very embodiment of the perfect example of the converse fallacy of accident. They have never knowingly experienced the supernatural so therefore they argue that it must not exist. This was the most disturbing aspect of the entire debate - that so much time was spent educating the atheists on their own beliefs. Finally it was agreed upon that modern atheism is the denial of acceptance that transcendental realities exist. Christopher Hitchens once said that the reason he debates theists is because the argument which underlies all arguments involves the belief in the existence of supernatural realities and the repudiation of that belief. And we at PPSIMMONS agree - that may have been the smartest thing that man ever said.

To clarify - Mike was asked by an atheist on the panel if a person develops the ability to climb Everest without supplemental oxygen would that person's children have that ability? He answered "why not?". He was laughed at and told he doesn't understand evolution - obvious straw man. Yet if the climber's child received the same training as the climber - then why WOULDN'T he be able to? Was the panel suggesting the climber's child would be too stupid to do it? You see, they were attempting to drag Mike into agreeing with them that evolution is true. They asked him to define evolution and when he didn't give the atheist version of deep time mythology they launched childish ridicule at him per the doctrine of elitism outlined in Mike's book offered as a PPSIMMONS resource.

Barack Hussein Obama - The Muslimchristianhindubuddhistatheist

In a recent "report" by Ulsterman with supposed ties to White House insiders and access to information from deep within the bowels of the Obama administration his contact talks about Bill Clinton, Hillary, Ron Paul, and the current resident in the WH - Barack Obama.

About half way through the profanity-laced piece the insider makes a claim which startles even Ulsterman - "He's an atheist you know".

Insider: Barack Obama. Atheist. So is Jarrett. Not that it matters…I don’t really care. No…I do care. I don’t like the lying about it. The bullsh-t way they go on using people. Pretending. That church in Chicago – it…for Obama it was just about connections. Leverage. Politics. Now I see them…getting the media to show them going into a church, hearing Obama talk about his religion…it’s all…it’s nothing to them. Nothing! God is a joke to those people. A punchline.

Add this to the list of other religious groups Barack Hussein Obama belongs to. Obama himself seems utterly confused as to his affiliation.

In that video Obama seems to be giving the Muslim community some very flattering and endearing praise indicating he very much associates himself with the religion of Islam. Yet in a Huffington Post article dated 9/29/10 -

President Barack Obama, in a rare discussion about his religious beliefs, described himself on Tuesday as a "Christian by choice" who arrived at his faith in adulthood because "the precepts of Jesus Christ" helped him envision the kind of life he wanted to lead.

So now we have Barack Obama associating himself with Jesus Christ - the God of Christianity who died for the sins of the world - a teaching which is blasphemous to the ears of Muslims and a heresy worthy of death in many parts of the world. But wait - it doesn't end there.

In a Nov 8/2010 news article by the BBC we learn that Barack Obama credited Gandhi with his Presidency while on a trip to India.

US President Barack Obama has paid tribute to Mahatma Gandhi in an address to the Indian parliament, saying studying the legacy of India's independence icon had helped propel him to the White House.

Obama described the personal impact of Gandhi's teachings of non-violence and equality on his political career and said he felt honoured to visit Gandhi's residence, where decades later Martin Luther King had stayed

So - now we see a conflation of Islam, Christianity, Hinduism, and Atheism. Anything else? Perhaps. The Buddhist Blog on blogspot (which hosts this blog) actually endorsed Obama for President because of his apparent ability to unite all people everywhere.

Barack Obama seems uniquely positioned to be a political leader able to unite people of all races, religions and citizens of the world. He may not know of the Buddhist teaching of interdependence but that is exactly what he has cultivated. He has been able to inspire people from all over America and the world with many different political views that we have more in common than not and that we have a responsibility to help each other. He has reminded us that the division of the past 8 years has caused a lot of suffering both here in America and in the world.

So now we can summarize the exact spiritual condition of Barack Hussein Obama. He has embraced Atheism, Islam, Christianity, Hinduism, and been endorsed by the Buddhists. Is there a name for an individual who conflates seemingly all of the world's philosophies into one? If there is a label one could ascribe to such a broad belief system what would it be? Here's the answer: Syncretism!

Barack Hussein is a syncretist. He isn't an atheist or a Muslim or a Christian or a Hindu or a Buddhist. He is a syncretist. So "what's the big deal" one might ask. The problem here is a lack of conviction - especially from the leader of the free world. Islam and Christianity do not lend themselves to conflation. They are polar opposites. Even though Jesus gets honorable mention in the Q'uran, it is certainly not the same Jesus spoken of in the Bible. And even Gandhi himself reckoned Christianity a false religion stating -

"I regard Jesus as a great teacher of humanity, but I do not regard him as the only begotten son of God. That epithet in its material interpretation is quite unacceptable. Metaphorically we are all sons of God, but for each of us there may be different sons of God in a special sense. Thus for me Chaitanya may be the only begotten son of God … God cannot be the exclusive Father and I cannot ascribe exclusive divinity to Jesus." (Harijan: June 3, 1937)

Barack Obama is attempting the impossible. Syncretism is not a viable worldview. Yet the evidence is overwhelming that Obama is a practicing syncretist.

THE POPE WAS RIGHT - Sanctioning "gay" marriage ruining the future of humanity

World Net Daily reported this week Pope Benedict XVI denounced gay marriage in his annual “State of the World” address Monday, going so far as to say the same-sex nuptials threaten the future of humanity.

Reporting on a New York Daily News article WND quoted them saying - in the speech, the pope, 84, unleashed what some consider being his strongest tirade against gay marriage, saying it is among conventions that “undermine the family” and “threaten human dignity and the future of humanity itself,” - a report which originated with REUTERS.

Rather than viewing the activity as degenerate, when society sanctions it there opens up the accepted void wherein those disgruntled with heterosexuality, even from a young age, more easily embrace the activity as normal rather than seeking help for something once seen in its true, heinous light. Generally speaking those with daddy issues lean toward the "gay" lifestyle (though not all) and now that we have a society with increasing numbers of absentee fathers we will see more and more homosexual tendencies and the acceptance of such will lead to an exponential crisis for humanity.

One wonders if the Pope was channeling the U.S. Center for Disease Control which has an article which details the savage effects men who have sex with men have had on the male population and the human population at large. From the CDC:

Gay, bisexual, and other men who have sex with men (MSM)1 represent approximately 2% of the US population, yet are the population most severely affected by HIV and are the only risk group in which new HIV infections have been increasing steadily since the early 1990s. In 2006, MSM accounted for more than half (53%) of all new HIV infections in the United States, and MSM with a history of injection drug use (MSM-IDU) accounted for an additional 4% of new infections. At the end of 2006, more than half (53%) of all people living with HIV in the United States were MSM or MSM-IDU. Since the beginning of the US epidemic, MSM have consistently represented the largest percentage of persons diagnosed with AIDS and persons with an AIDS diagnosis who have died.

It is exactly because of this unreported truth (at least in the main stream) that men who have ever had sex with men are never permitted to give blood; yet another reason that particular lifestyle is damaging the future of humanity. Think of the life-giving blood supply which is robbed of crucial stock simply because a politically correct society has taken leave of its senses and embraced the activity which leads to such destructive results.

So cudos to the Vatican for daring to speak the truth about this plague on the human experience. Now if only this type of boldness were as contageous as the diseases caused by the activity which the Pope has denounced in his speech... if only.

World's OLDEST Preacher - Bishop Otis G Clark -109 YEARS OLD

Bishop Otis G. Clark was born on February 13, 1903, in Meridian, Oklahoma before Oklahoma was even a state. At the time it was Indian Territory. Evangelist Clark is 107 years old. At the age of eighteen. Otis was caught in the "1921 Tulsa Race Riot" in the Greenwood District of Tulsa, Oklahoma. At the time Greenwood was a mecca for African-Americans who owned their own successful businesses due to the oil boom. This riot was one of the worse race riots on American soil caused by jealously. As a young man fleeing for his life he hoboed on a train to California looking for his biological father and left Tulsa for many years.

Clark was heavily involved with the original Azusa Street Mission members. The Azusa Street Revival began in 1906 and was led by William J. Seymour in Los Angeles, California. Before the Azusa Street Mission building was torn down, Clark was given the Power of Attorney by Bishop Driscoll over the Azusa Street Mission. He still has the original document. Samuel M. Crouch of Los Angeles, California officially ordained Clark as a preacher - this took place at 33rd and Compton Street in Los Angeles. He also had the honor of serving Charles H. Mason, whom he affectionately called “Dad.” Bishop Mason is the founder of the Church of God in Christ.

While living in California, Clark had the opportunity to rub shoulders with many rich and famous actors. He knew a young man named Steppin’ Fetchit. Steppin’ Fetchit chose Clark to be a friend and buddy. Clark also had the opportunity to serve Clark Gable, Joan Crawford and Charley Chaplin, some of America’s most famous movie stars. Clark and his wife lived in Joan Crawford's home. He was the butler and she was the cook.

The years of 1929-1932 represented dark and desperate days for America, known as The Great Depression. In the midst of the chaos of this time - God blessed Clark. During The Great Depression he was well provided for with ample food and clothing. Not once did he stand in a bread or soup line.

To the glory of God, he has served as an International Minister for over 80 years, longer than the average life expectancy. Clark is presently going strong at the young age of 109 as he continues to preach and write about the oracles of God.

He still lives independently

He threw out the ceremonial first pitch for the Boston Red Sox the year they won the World Series

He traveled on a mission trip to Africa. The first when he was 103 yrs old and the second when he was 104 yrs old and went to the West Indies at 107

He is the world's oldest traveling minister

He attended the second World's Fair in 1933 in Chicago, IL...and guess what they previewed?...The TELEVISION.

Obama labels Tea Party "EXTREMIST" four days after signing NDAA - Is America finished?

The Obama people started the campaign off with a BANG the first of the year. Obama’s campaign director, in a bulk email to the supporter email list, which we happen to be on, named the enemy… and his name is Carl Gallups! Well, they didn’t name him personally but they may just as well have.

In the email dated January 4 2012 Jim Messina, Campaign manager for Obama for America labeled the Tea Party as “extremists”. Here’s the quote.

“The Extremist Tea Party agenda won a clear victory”. He was speaking here of the Iowa Caucus Tuesday night. The word “extreme” is used more than once throughout the email. We’ll post the entire text in the description of this video.

But notice with me the timing of this email. Only four short days after signing the NDAA – the bill you’ve all been reading about and hearing about since it was signed Dec 31^st, the last day of 2011.

The NDAA solidifies the power of the President to arrest and indefinitely detain, without due process, American citizens who Obama personally identifies as a threat to national security. And now – a mere four days later, Obama’s campaign team has begun to set the narrative. The Tea Party are extremists. According to the Obama email, the Tea Party extremist agenda threatens Medicare, the troops, gay rights, women’s rights, social security, and much more. These Republican candidates spent in some cases more than a year -- in Mitt Romney's case seven years -- campaigning in Iowa to be the next president.

2) We'll be facing an onslaught of unprecedented spending from outside groups funded by corporations and anonymous donors. In Iowa alone, so-called "super PACs" spent $12.9 million on almost exclusively negative ads. These groups will turn their fire even more directly on us in the weeks ahead to prove that their candidate is the most anti-Obama.

This race is officially on -- and if we want to win, the only way is to out-organize them on the ground.

Many observers still think Mitt Romney will be the Republican nominee. If he is, we will be prepared. But it's curious that no one can really explain how, when or why the 70-plus percent of Republicans saying in polls and in Iowa that Mitt Romney's not their candidate will suddenly come around.

So the path ahead for Romney -- or whichever of the Republican candidates is going to emerge from this process -- is sadly and starkly very clear: to run even further to the extreme right, and make even more dangerous promises that threaten not only the progress we've made but the fundamental fabric of American society.

We also know that candidates who take these extreme positions can, in the right circumstances, win not only a primary but also a general election in just about any state.
Just ask the Tea Party senators from Pennsylvania and Kentucky, and the Tea Party governors in Florida and Wisconsin.
Watching the circus on TV, it's tempting to think it's almost funny -- but this is not a joke.
We've got to be ready.

Obama Campaign Labels Carl Gallups "Extremist"

Let the attacks begin! In the latest email from the Obama campaign the email headline reads "This is not a joke"!

So they're serious are they? Serious about the statements made in this email? Let's examine one of them.

Carl Gallups is a loud and proud member of the Tea Party. Not only that but he is also an honored speaker at several of their events including most recently the Florida Tea Party Convention held in Dayton.

Pastor Carl of PPSIMMONS was invited to be the first after-dinner speaker at the Daytona Tea Party Convention for the State of Florida in November of 2011. There were 1,500 in attendance at the dinner and the speech that night. This video is Carl's entire 19 minute presentation. You can hear the audience reaction throughout. Carl received several standing-ovations during his speech that were not recorded on camera - however, you can see the rousing ovation he receives at the conclusion of his speech as the camera does a brief pull-away.

What does any of this have to do with the latest Obama email? Plenty! The email from Jim Messina, campaign manager - Obama for America, addressed the Iowa Caucus held Tuesday night and makes two main points. The first was this:

No matter who the Republicans nominate, we'll be running against someone who has embraced that agenda in order to win -- vowing to let Wall Street write its own rules, end Medicare as we know it, roll back gay rights, leave the troops in Iraq indefinitely, restrict a woman's right to choose, and gut Social Security to pay for more tax cuts for millionaires and corporations."

So - the Obama campaign wishes to "label" themselves into a win. Tea Party members are "extremist"? So, essentially, they've labeled Carl Gallups and all the rest of regular America who want their country back "extremist". Can you spot the narrative? Do you see where this is clearly going?

We're not going to bother addressing each point one by one. It is sufficient to say that Obama and his people want to wage a campaign which marginalizes those who value the constitution, the family, right to self defense, right to self determination, taxation with representation, limited government intrusion, conservative values, and just plain old common sense. He wants socialism and the cradle-to-grave nanny state to become entrenched into the America way of life.

So look out America. Your president is gunning for your weapons, your flag, your money, your family, and your freedom as you now know it. The drones are flying over U.S. cities, the TSA is groping your kids, and now the average small town Tea Party member is an extremist! God bless help America!

What REALLY Killed Christopher Hitchens

At the PPSIMMONS youtube channel we were attacked in the comment section by theists and atheists alike for suggesting that God killed Christopher Hitchens by giving him throat cancer. Yet that is not at all what we were saying nor trying to imply. We simply pointed out the irony of it. Not all irony is God-breathed. Something can be ironic without God being responsible for it. This should have been obvious to most people but atheism needs a coping mechanism and this angry form of jumping to conclusions is the apparent modus operandi of modern atheism.

But getting back to how Hitchens died the answer is stupendously obvious and was even given by the atheists themselves in the comment section of the video. We eventually had to close comments on this video we made about Hitchens because of the foul nature of the attacks against us from the atheists. Watch the video below and then we'll discuss how Hitchens really died.

Many of the comments pointed out that he died because of his lifestyle. We agree. The drinking and smoking and genetic predisposition inherited from his father who also died of the same disease is what killed him. But what is this lifestyle called? Is there a name for the kind of living that caused his early death? In fact there is. It's called "liberalism".

Liberalism is one of the tenets of modern atheism. This, and the other tenets of the religion, are clearly outlined in the PPSIMMONS book "The Atheists are Wrong". Liberalism is a mental disorder as defined in the dictionary. It is defined as an "unrestricted" lifestyle. This is what killed Christopher Hitchens. God is not responsible for his death. He did it to himself. He committed a suicide of sorts. Christopher Hitchens was killed by atheism.

No one can live a truly liberal life and expect to live in freedom. Liberalism as a lifestyle is like opening up that brand new lap top, plugging it in, logging on to the internet, all without any antivirus protection or firewall at all. Just go online and let whatever can happen - happen. Guess what - it won't take very long to fill up with viruses and eventually see your computer crash. But it gets even worse. Since you're a liberal man you're all over the porn sites, gambling sites, and buying all this stuff with your credit card while completely unprotected. Now the hackers have your financial information and drain your back account.

The vast majority of people do not live liberal lives. They recognize that in order to live a truly free life they must invoke conservative principles. They understand that they must self-restrict. If Christopher Hitchens had realized this basic understanding earlier he would likely be alive today. If he had made the common-sense choice to jettison the atheist tenet of liberalism like his brother did, he would not have died at such an early age. He would still have died, but atheism would have been robbed of its chance to put him in an early grave.

Subtitle D--Counterterrorism

SEC. 1021. AFFIRMATION OF AUTHORITY OF THE ARMED FORCES OF THE UNITED STATES TO DETAIN COVERED PERSONS PURSUANT TO THE AUTHORIZATION FOR USE OF MILITARY FORCE.
(a) In General- Congress affirms that the authority of the President to use all necessary and appropriate force pursuant to the Authorization for Use of Military Force (Public Law 107-40; 50 U.S.C. 1541 note) includes the authority for the Armed Forces of the United States to detain covered persons (as defined in subsection (b)) pending disposition under the law of war.
(b) Covered Persons- A covered person under this section is any person as follows:
(1) A person who planned, authorized, committed, or aided the terrorist attacks that occurred on September 11, 2001, or harbored those responsible for those attacks.
(2) A person who was a part of or substantially supported al-Qaeda, the Taliban, or associated forces that are engaged in hostilities against the United States or its coalition partners, including any person who has committed a belligerent act or has directly supported such hostilities in aid of such enemy forces.
(c) Disposition Under Law of War- The disposition of a person under the law of war as described in subsection (a) may include the following:
(1) Detention under the law of war without trial until the end of the hostilities authorized by the Authorization for Use of Military Force.
(2) Trial under chapter 47A of title 10, United States Code (as amended by the Military Commissions Act of 2009 (title XVIII of Public Law 111-84)).
(3) Transfer for trial by an alternative court or competent tribunal having lawful jurisdiction.
(4) Transfer to the custody or control of the person's country of origin, any other foreign country, or any other foreign entity.
(d) Construction- Nothing in this section is intended to limit or expand the authority of the President or the scope of the Authorization for Use of Military Force.
(e) Authorities- Nothing in this section shall be construed to affect existing law or authorities relating to the detention of United States citizens, lawful resident aliens of the United States, or any other persons who are captured or arrested in the United States.
(f) Requirement for Briefings of Congress- The Secretary of Defense shall regularly brief Congress regarding the application of the authority described in this section, including the organizations, entities, and individuals considered to be 'covered persons' for purposes of subsection (b)(2).
SEC. 1022. MILITARY CUSTODY FOR FOREIGN AL-QAEDA TERRORISTS.
(a) Custody Pending Disposition Under Law of War-
(1) IN GENERAL- Except as provided in paragraph (4), the Armed Forces of the United States shall hold a person described in paragraph (2) who is captured in the course of hostilities authorized by the Authorization for Use of Military Force (Public Law 107-40) in military custody pending disposition under the law of war.
(2) COVERED PERSONS- The requirement in paragraph (1) shall apply to any person whose detention is authorized under section 1021 who is determined--
(A) to be a member of, or part of, al-Qaeda or an associated force that acts in coordination with or pursuant to the direction of al-Qaeda; and
(B) to have participated in the course of planning or carrying out an attack or attempted attack against the United States or its coalition partners.
(3) DISPOSITION UNDER LAW OF WAR- For purposes of this subsection, the disposition of a person under the law of war has the meaning given in section 1021(c), except that no transfer otherwise described in paragraph (4) of that section shall be made unless consistent with the requirements of section 1028.

(b) Applicability to United States Citizens and Lawful Resident Aliens-
(1) UNITED STATES CITIZENS- The requirement to detain a person in military custody under this section does not extend to citizens of the United States.
(2) LAWFUL RESIDENT ALIENS- The requirement to detain a person in military custody under this section does not extend to a lawful resident alien of the United States on the basis of conduct taking place within the United States, except to the extent permitted by the Constitution of the United States.
(c) Implementation Procedures-
(1) IN GENERAL- Not later than 60 days after the date of the enactment of this Act, the President shall issue, and submit to Congress, procedures for implementing this section.
(2) ELEMENTS- The procedures for implementing this section shall include, but not be limited to, procedures as follows:
(A) Procedures designating the persons authorized to make determinations under subsection (a)(2) and the process by which such determinations are to be made.
(B) Procedures providing that the requirement for military custody under subsection (a)(1) does not require the interruption of ongoing surveillance or intelligence gathering with regard to persons not already in the custody or control of the United States.
(C) Procedures providing that a determination under subsection (a)(2) is not required to be implemented until after the conclusion of an interrogation which is ongoing at the time the determination is made and does not require the interruption of any such ongoing interrogation.
(D) Procedures providing that the requirement for military custody under subsection (a)(1) does not apply when intelligence, law enforcement, or other Government officials of the United States are granted access to an individual who remains in the custody of a third country.
(E) Procedures providing that a certification of national security interests under subsection (a)(4) may be granted for the purpose of transferring a covered person from a third country if such a transfer is in the interest of the United States and could not otherwise be accomplished.
(d) Authorities- Nothing in this section shall be construed to affect the existing criminal enforcement and national security authorities of the Federal Bureau of Investigation or any other domestic law enforcement agency with regard to a covered person, regardless whether such covered person is held in military custody.
(e) Effective Date- This section shall take effect on the date that is 60 days after the date of the enactment of this Act, and shall apply with respect to persons described in subsection (a)(2) who are taken into the custody or brought under the control of the United States on or after that effective date.
